Water Rights: Use it or Lose it

The Arizona Department of Water Resources requires wells to report annual withdrawals to be filed no later than March 31st of each year for the preceding year.  This Annual report must be filed regardless of whether or not water was used pursuant to the right or permit.  If you own vacant land for investment purposes that includes a well which may be capped and currently not in use make certain your well and water rights are listed with the Arizona Department of Water Resources (azwater.gov ). Note the good drill date / Type of water right (Type I or II) and permitted annual withdrawal right.

 

The State of Arizona filed a judication to all property and/or well owners over 20 years ago.  Everyone including All Indian Tribes, Mining Co.s, Companys, Partnerships and private landowners must register your water rights—USE IT OR LOSE may come to bite anyone that has not filed its claim for water right with ADWR.  It can be recommended to periodically pump any capped well to make sure your pumping capacity and static water level remains constant.  Water tables do change!
